SMS Privacy Policy

Tim Tung for School Board 2026 (the “Committee,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use https://www.timtung.com, interact with our services, or participate in the recurring text-messaging program (the “Messaging Program”).

1. Scope

This Privacy Policy applies to information collected through our website, forms, customer-service channels, transactions, and the Messaging Program. It does not apply to third-party websites or services that we do not control. Additional notices may apply to a specific product, service, or jurisdiction; if an additional notice conflicts with this Policy, the more specific notice controls for that context.

2. Information We Collect

We may collect the following categories of information, depending on how you interact with us:

• Contact and account information, such as your name, email address, mailing address, account identifiers, and preferences.
• Mobile and messaging information, such as your mobile number, carrier, the date and method of consent, opt-in and opt-out records, HELP requests, message content, delivery status, and related timestamps.
• Transaction and service information, such as requests, appointments, orders, payments, donations, event registrations, support history, or other interactions with the Committee.
• Website and device information, such as Internet Protocol address, browser type, device identifiers, pages viewed, referring pages, approximate location derived from IP address, and cookie or analytics data.
• Information you submit in forms, surveys, replies, applications, or customer-care communications.
• Information from service providers and public sources, but only where permitted by law and consistent with the purpose for which the information was collected.

3. How We Use Information

We may use personal information to:

• Provide, administer, personalize, and improve our website, services, transactions, and Messaging Program.
• Send the specific types of messages described when you enrolled, including recurring political and advocacy communications, campaign updates, voter-engagement information, election and event notices, volunteer opportunities, and donation solicitations.
• Process and document consent, honor STOP and other preference requests, and respond to HELP or support inquiries.
• Authenticate users, protect accounts, detect fraud, prevent abuse, troubleshoot delivery, and maintain security.
• Measure service performance, understand usage, and conduct internal analytics.
• Comply with applicable law, carrier requirements, provider rules, legal process, audits, and recordkeeping obligations.
• Communicate about material changes, service notices, or other matters reasonably related to your relationship with us.

4. SMS Consent and Preferences

Consent to the Messaging Program is specific to the Committee, the identified Messaging Program, and the message categories disclosed when you enroll. We do not treat consent as permission for another brand, candidate, committee, affiliate, or organization to send text messages.

Providing a mobile number in connection with a donation, event registration, volunteer form, survey, petition, inquiry, public record, or other interaction does not by itself constitute consent to receive recurring text messages. You must directly and affirmatively opt in to the Messaging Program.

We do not buy, sell, rent, exchange, or transfer SMS consent, and we do not use purchased lists, third-party lists, public records, or voter-registration databases as a substitute for direct consent.

No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. All categories of disclosure described in this Policy exclude SMS opt-in data and consent; this information will not be sold, rented, transferred, or shared with third parties or affiliates.

We use messaging vendors and telecommunications carriers solely as service providers acting on the Committee’s behalf to operate the Messaging Program, transmit messages, maintain consent records, provide support, and honor opt-out requests. They may not use mobile information, SMS opt-in data, or consent for their own marketing, promotional, or independent purposes.

Consent is not a condition of making a donation, purchasing goods or services, receiving services, or submitting an inquiry. You may withdraw consent at any time by replying STOP. For assistance, reply HELP or contact us using the information below. Message and data rates may apply. Message frequency varies, up to 8 messages per month.

5. How We Disclose Information

Except for the limited processing of mobile information described in Section 4, the disclosures below exclude mobile information, SMS opt-in data, and SMS consent.

• Service providers. We may permit service providers to process other personal information on our behalf for functions such as website hosting, donation processing, security, technical support, analytics, and fraud prevention. These providers may use the information only to perform services for the Committee or as required by law and may not use it for their own marketing or promotional purposes.
• Legal and safety purposes. We may disclose information when reasonably necessary to comply with applicable law or legal process, protect rights, safety, or property, investigate fraud or abuse, or enforce applicable terms.

We do not sell personal information, mobile information, or SMS consent, and we do not disclose mobile information or SMS opt-in data to another candidate, committee, political organization, affiliate, or third party for marketing or promotional purposes.

6. Cookies and Similar Technologies

Our website may use cookies and similar technologies to operate the site, remember preferences, understand usage, and improve performance. You may be able to control cookies through your browser or device settings. Disabling some cookies may affect website functionality.

7. Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including providing services, documenting consent and opt-out requests, resolving disputes, maintaining security, and meeting legal, accounting, carrier, or contractual requirements. Retention periods vary based on the type of information and the reason it was collected.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No system or transmission method is completely secure, and we cannot guarantee absolute security. You should not send sensitive information by text message unless we specifically request it through an appropriate process.

9. Your Choices and Privacy Rights

You may:

• Opt out of the Messaging Program by replying STOP (we also honor QUIT, END, REVOKE, OPT OUT, CANCEL, UNSUBSCRIBE, and other reasonable requests that clearly communicate a desire to stop receiving messages). We will send one non-promotional message confirming your opt-out.
• Request help by replying HELP or contacting tungforschoolboard@gmail.com.
• Update your contact information or communication preferences by contacting us.
• Request access to, correction of, or deletion of personal information, subject to applicable law and permitted exceptions.
• Use available browser, device, or website controls for cookies and similar technologies.

Depending on where you live, you may have additional privacy rights. We may need to verify your identity before completing a request. We will not discriminate against you for exercising rights provided by applicable law.

10. Children’s Privacy

Our services and Messaging Program are not directed to children under 18. We do not knowingly collect personal information from children in violation of applicable law. If you believe a child has provided information improperly, contact us so that we can review and address the matter.

11. Third-Party Links

Our messages or website may contain links to third-party sites. Their privacy practices are governed by their own policies. We are not responsible for third-party content or privacy practices.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the revised version on this page and update the effective date. When required, we will provide additional notice or obtain new consent before materially expanding the categories of text messages you receive.
